Terms & Conditions

All guests making reservations through VIVESTIA are required to accept these terms and conditions. Your reservation is not confirmed until you have agreed to and executed this Agreement.

By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:

a. He/she has read these terms and conditions and any other specifical terms and conditions either located in this Website, either sent via email/fax, and has the authority to and does agree to be bound by them;

b. He/she consents to our use of information in accordance with our Privacy Policy and is authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements);

c. He/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services.

d. He/she accepts financial responsibility and liable for payment of the booking on behalf of all persons detailed on the booking.

e. He/she and all other members of the party do not have a criminal record.

A. Introduction:

The following are the general terms applicable to any reservation made through VIVESTIA. The specific terms (such as rent/day, duration of your stay, prohibitions, security deposit etc.) for the specific property you are interested in reserving will be included in the Booking Form, which will be sent to you via fax or email after you make an inquiry for a specific property.

Please note that VIVESTIA is acting solely as a Booking Agent in the name and on behalf of the Villa Owner (or any authorized agent for the Property), for the rental of the property, as well as for the Service Provider (any independent provider of services such as catering, chauffeur, etc.) for the services requested.

B. Terms:

- Property/Villa: the specific property you enquired and reserved through VIVESTIA;

- Property Owner/Villa Owner: the natural person or legal entity that owns or has the legal right to lease the Property to third parties;

- Visitor/Villa Visitor/You: the person whose name the booking is made in

- Services: any services from the list of services included in the Website the Villa Visitor choose to request and book for the rental period.

- Experiences: any activities from the list included in the Website the Villa Visitor choose to request and book for the rental period.

- Groceries Budget: the total sum for groceries and other essentials the visitor chooses to select in case the Visitors have requested vendor services.

- Booking Form: the document containing the conditional offer for the rental of the Property and specific terms of the lease;

- Rental Period: the term of the lease;

- Short-Term Lease Agreement: the agreement between you and the Property Owner/Villa Owner for the lease of the Property/Villa.

- Payment Schedule: the schedule defining the due dates and amount of payment to be made for the booking  

- Security Deposit: is the sum of money the Villa Visitor paying in cash to the Villa Owner or a representative of the Villa Owner in accordance with the terms agreed hereto and in the Booking Form as a safeguard for any damages made to the Villa. If no damages occur during your stay the sum is returned to you in full according to the terms agreed hereto and in the Booking Form.

- Total Amount Payable: the payable sum for renting the Villa for the lease period and for the services you might require, including any applicable taxes and/or charges.

- Initial payment: the part of the Total Amount Payable which is payable according to the provisions of the Payment Schedule.

C. General Terms

1. BOOKING

1.1 Our Booking Terms and Conditions and your Booking Form contain all provisions of your booking with VIVESTIA. This applies equally to the Villa Visitor and all guests included in the Booking Form as ‘Occupants/Guests’.

1.2 Your receipt of the Booking Form constitutes our conditional offer for the rental of the Vila and for any additional services that you have requested. This offer is subject to our receipt of the Booking Form, duly completed and signed by you within 24 hours from the e-mail or fax transmission of the Booking Documents to you and to the duly payment of the sums as described on the Payment Schedule of page 1 of the Booking Form. If we do not receive the completed and signed Booking Form within the above deadline, our conditional offer will expire and your provisional booking will be canceled.

1.3 Your booking pertains to accommodation in a furnished luxury property with cleaning and any catering or other auxiliary services that you have requested, as mentioned in the Booking Form or any other relevant documentation. We visit and check each property regularly. The information about each property on our website is accurate to the best of our knowledge. We will inform you as soon as possible of any major changes to the property that may render accommodation substantially different from what you have booked. We cannot be held liable for any modifications/alterations or differences in the Property’s condition made to the property without our prior knowledge. Please be aware that we use a fictional name for most of the properties in our portfolio for marketing purposes.

2. BOOKING AGENT FEE

2.1. For the agent services provided by VIVESTIA, you will be charged a fee of the amount of 5% of your Total Amount Payable, which is considered fair by the parties, unless a different amount is agreed on occasion between the parties.

2.2. This sum should be transferred to VIVESTIA’s Bank Account and is payable on the date agreed in the Payment Schedule on page 1 of the Booking Form.

2.3. VIVESTIA reserves the right to change the aforementioned rate, without any prior notice.

2.4. VIVESTIA reserves the right to offer in its own discretion promotions such as loyalty programs, discounts for marketing purposes etc. at any time in all or some of its exciting or future clientele.

3. PAYMENTS

3.1. In order for this offer to become a firm booking, we ask that you follow the Payment Schedule on page 1 of the Booking Form, according to which:

a. The Initial Payment of 30% of the Total Amount Payable must be in our Bank Account within 24 hours of your receipt of the Booking Form by VIVESTIA, according to clause 1.2. The remaining 70% must be paid up to eight (8) weeks before the first day of the Rental Period. If your reservation is made within eight (8) weeks before the first day of the Rental Period, payment of the Total Amount Payable must take place within two (2) days of confirmation of receipt of the duly completed and signed Booking Form by VIVESTIA.

b. The Security Deposit must be paid in cash directly to the Villa Owner or a representative of the Villa Owner during your check-in. If you don’t pay the Security Deposit in cash the Villa Owner and/or VIVESTIA reserves the right to immediately cancel your reservation and refuse your access to the property, without reimbursing you.

3.2. Payment must be made through remittance to our Bank Account. Please take into account that it may take up to two or three working days for the money transfer to be processed and deposited in accordance with your Bank Policy and standing legislation and you are solely responsible for scheduling the payments accordingly.

3.3. The Total Amount Payable, the deposit, the Booking Agent Fee and any and all other amounts payable by the Visitor should be paid in Euro. Any and all applicable fees, sums, commissions, taxes, i.e. exchange fees, currency difference, bank commission etc., which may apply are burdened by the Visitor.

3.3. If payments, as specified in the Payment Schedule, are not received by their respective due dates, or you do not adhere to any other provision in all Booking Documents, the Villa Owner and/or VIVESTIA reserve the right to immediately terminate this agreement and cancel your booking. You shall be refused access to the Property. In this event, the cancellation policy as per article 6 of this document shall apply.

4. BOOKING CONFIRMATION DETAILS

Once we have received the Total Amount Payable according to the Payment Schedule, you shall receive a Booking Confirmation from VIVESTIA by e-mail or fax. Please read this confirmation carefully and contact VIVESTIA immediately if the information contained therein is incorrect or incomplete. VIVESTIA shall not be obliged to rectify any errors or omissions that are reported more than 24 hours after transmitting the confirmation.

5. REPRESENTATION

You hereby authorize and appoint any company belonging to VIVESTIA to act on your behalf and in your name in order to prepare and sign the Short-Term Lease Agreement for the Property with the Owner under the terms included herein and in the Booking Form or any other document and you undertake to hold harmless and indemnify such companies and any officers and/or employees of such companies signing the Short-Term Lease Agreement for the Property with the Owner from any claim arising out of or in connection with the signing of such Short-Term Lease Agreement for the Property.

6. CHANGES & CANCELATION BY YOU

6.1 If you wish to make any changes to your confirmed booking, you must notify us in writing as soon as possible and we will try to adjust to the proposed changes, without charging additional charges, if that is feasible, however, we cannot guarantee that such requests will be fulfilled. If the above-mentioned changes result in additional cost, you will be informed in writing on the changes and the cost which will be included in our agreement, while article 4 of the present will apply concerning the payment of the additional cost.

6.2 If you wish to cancel your booking, you must inform us immediately in writing. The following cancellation policy shall apply if a replacement booking does not materialize:

Cancellation by You:

1.   More than 8 weeks before the first day of the Rental Period:
Initial payment of 30% and Booking Agent fee shall not be refunded

2.   Less than 8 weeks before the first day of the Rental Period:
No refund will be made

3.   In all the above-mentioned cases the Grocery Budget shall be refunded

6.3.       This is the general cancellation policy applied by VIVESTIA. However, in some cases, the Villa Owner might have a different cancellation policy, in which case you will be presented with it before your booking and the terms and provision of which will be included in the Booking Form.

7. CANCELLATION OR CHANGES BY VIVESTIA

In the exceptional circumstance where we can no longer provide you with the Property you have booked, you will have a choice between one of the following options for the same Rental Period:

i) Accept an alternate property of equivalent or superior rating for the same Rental Period, or

ii) Accept an alternative property of lower rating for the same Rental Period and receive a credit note for the difference in the Overall Cost between the original and the substitute property.

iii) If neither option above is possible or if you do not wish to accept an alternative property, we will cancel the booking and refund all money paid to us. We shall not be held liable and shall not pay any further compensation/ damages nor shall we accept any other claims derived from the cancellation.

8. GENERAL TERMS OF LEASE

8.1. The rental price per night is either demonstrated publicly in the Website or is available to the Visitor upon request. The final agreed price per night is included in the Booking Form. Utilities are included in the rental price. Please note that some of our properties do not have telephone nor Internet services unless specified otherwise. In this case, we strongly recommend traveling with at least one mobile phone. When Satellite TV and/or Internet service is provided at the property, we cannot guarantee we will be able to re-establish the connection in case of a technical problem beyond our control, such as a faulty line from the local telephone company. Some properties feature internet at extra cost.

8.3. The lease agreement between you and the Villa Owner is a Short Term Lease, beginning on the first Rental day of the Lease Period and ending on the Last Rental Day of the Lease Period, as those are specifically agreed in the Booking Form. You are expected to evacuate the Villa, without any other notice, at the latest at the end of the Last Day of the Lease (i.e. at 11 am.). If you do not evacuate the Property on the Last Day of the Lease you will be charged according to clause 8.4. In case you refuse to leave after the hours specified in clause 8.4. the Security Deposit will be held by the Villa Owner as a penalty, the authorities will be called, and you will be held liable for any other loss or damage of the Owner and/or VIVESTIA.

8.2. Main food supplies (groceries, meat, vegetables, etc), alcoholic drinks, bottled water or other supplies are NOT included in the rental price. Such services are available with an extra charge upon request.

8.3. The Villa Owner reserves the right to enter the property for inspection at all times with reasonable warning/notice to the Villa Visitor. Supporting personnel (maid, gardener, pool/Jacuzzi maintenance people) can enter the property at pre-agreed times (please discuss with the villa manager on your check in).

8.4. Unless otherwise specifically agreed Rental day ends at 11:00 am. ⁃ Guests staying after 11:00 am will be charged 1/2-day rental ⁃ Guests staying after 17:00 pm will be charged a full day rental

8.5. Check-in and Check-out hours are agreed for every Property individually and you will be notified of those in your Booking Form. We will try to accommodate requests for early check-in and late check-outs, but cannot guarantee feasibility. In some cases, extra charges might apply to early check-ins and late checkouts.

8.6. During the check-in, you are solely responsible for checking that the whole Property meets your requirements and the description of the Villa provided to you by VIVESTIA (either in writing or through the website). If it doesn’t meet your requirements you should immediately contact VIVESTIA, who will then attempt to resolve the problem

If you see any damages and/or discrepancies (such as broken items, damaged furniture etc.) you should immediately take photographs of the aforementioned damages and/or discrepancies and send them to VIVESTIA via email, so you will not be held liable for those during your check out. If you fail to follow the aforementioned procedure during your check-in you might be held liable for those damages or discrepancies at the end of the lease period. Complaints received at the end of the tenancy will not be accepted. If the problem was not resolved to your reasonable satisfaction during your stay, you should put your comments in writing within 7 days of your return. We will forward your written complaint to the Owner and will within reason liaise with the Villa Owner to assist in reaching a satisfactory settlement for all justifiable complaints regarding the property you may have.

8.7. Notwithstanding the above, by checking in you accept that the Villa is in the agreed condition and suitable for the agreed use and simultaneously waive any and all rights for challenging the aforementioned condition of the Villa and all rights that may derive from it under the Greek law.

8.8. If the Villa does not meet your requirements and you chose to vacate the property before the departure date, you should first contact VIVESTIA. If you fail to do so, you will not necessarily be entitled to a refund.

8.9. Procedure for check-in will be the responsibility of the villa owner or property manager.

8.10 It is not allowed to change the setting or decoration of the houses (including furniture placement). Inside furnishings stay inside and outside furnishings outside. Rearranging the houses can lead to cancellation of the booking and forfeiture of the whole stay and damage deposit amount.

8.11. Please note that in most cases the water in the Villa is not drinkable. You will be notified before you arrive about the suitability of the water. VIVESTIA waives any and all liability for any claims that might arise hereto. We strongly advise you to have a medical plan that will cover any medical expenses in Greece. In case of sickness or injury, we will do our best to have the patient reach professional medical assistance, the soonest as possible. If you or a member of your family has any serious chronic condition, including severe allergies, you are obliged to inform us in advance. Bring ample supplies of the medications you normally need or take, it may be difficult to find on location. If you are allergic to bees or wasps common in Greece during the summer, please inform us and bring antidotes.

9. USE OF PROPERTY

9.1 Only those persons stipulated on your Booking Form may occupy the Property. The number of guests staying overnight in the Property may not exceed the Maximum Occupancy indicated on your Booking Form. In the event the number of guests exceeds the Maximum Occupancy, we reserve the right to ask all guests to vacate the Property immediately.

9.2. You shall use the Property only for the purpose for which it has been let to you (personal lodging). It is forbidden to use the premises for any kind of commercial use during the rental (photoshoots, seminars), and/or to hold parties for entertainment or a function involving a large number of invitees unless expressly agreed upon in writing by VIVESTIA or the Owner. Should you make unauthorized use of the Property as indicated, we and the Villa Owner reserve the right to ask all guests to vacate the Property immediately and ask for remuneration. You shall not sublet the Property under any circumstance whatsoever. Photographs taken at the Property cannot be used for publication or sold for profit without written authorization by VIVESTIA and the Villa Owner.

10. VILLA OWNER

10.1. The Villa Owner reserves the right to terminate the leasing agreement effective immediately with or without reimbursing you, in case he has evidence or receives complaints about the impeachment of Greek Law.

10.2. The Villa Owner reserves the right to terminate the leasing agreement and ask the visitor to evacuate the Property immediately without reimbursing you, in case you violate in any way the terms of this present and/or the terms of Booking Form and ask for compensation for any further loss or damage derives from the aforementioned violation of the terms.

10.2. The Villa Owner reserves the right to cancel and refund in full any reservation due to unforeseen weather conditions, Acts of God, property damage or other forms of forced property unavailability and or/to move/change guests’ other accommodation –if available- in the area, with Visitor’s prior consent.

10.3. In case of a cancellation due to external factors (Acts of God, Force Majeure), in no circumstance, will the Villa Owner be responsible for consequential damages of such cancellation (ticket loss, extra charges, etc) and no such claim(s) will be honored.

11. CLEANING, MAID & COOK SERVICE

11.1. The property will be cleaned at the beginning of the rental period and clean linens and towels will be provided, before your arrival. General Maid services and linen/towel changes differ between the Villas, and you will be notified of the specific services provided without extra charge in the Villa you requested.

11.2. Should you require extra maid service, please advise us at the time of booking. We cannot guarantee availability at any time but we will do our utmost to satisfy your request. All quoted charges will need to be prepaid at the time of booking the specified extra service. A third-party cleaner is not allowed to have access to the property at any time.

11.3. Properties are expected to be handed over tidy and clean. An extra cleaning fee may be subtracted from the security deposit if the property is left excessively dirty or in a mess.

11.4. VIVESTIA, even though will do anything in our power to ensure high-quality provision of services, is not responsible for the maid or any other cleaning personnel included in the Villa nor for the quality of the services provided by them nor the cleaning substances they use. Should any person in your party have allergies to washing/cleaning substances they should inform VIVESTIA beforehand and they should bring their own linen. The same applies in case food services, such as food baskets, welcome drinks etc. are provided, with or without charge.

11.5. Most Villas do not provide cook service unless specified otherwise. Should you require a private cook or a caterer, please advise us at the time of booking. We cannot guarantee availability at any time, but we will do our utmost to satisfy your request. All quoted charges will need to be prepaid at the time of booking the specified extra service. A third-party private cook or caterer is not allowed to have access to the property at any time.

12. WORKING HOURS OF STAFF (STAFFED BOOKINGS ONLY)

Employed professional staff (chefs, butlers, hosts, chauffeurs, etc) are available for work for a total of 8-10 hours per day unless otherwise agreed between you and VIVESTIA. If their services are required for additional hours per day there will be a surcharge for overtime.

13. SWIMMING POOLS

13.1. The swimming pool, when available, will be kept clean and operational by the property staff. If your rental period is before 1st June or after 15th October, please check with us if the swimming pool will be operational. An additional charge may apply for operating the pool heating system, if available.

13.2. Some, but not all, properties will provide pool towels for guest use. Beach towels are usually not provided.

13.3. You are solely responsible for keeping the applicable safety measures when using and/or being around the immediate area of the pool and VIVESTIA waives any and all liability for any accident, injury, or death that may occur. Please never leave Children unattended playing around or being inside the pool. If you choose to use the pool, you are doing so at your own risk and you must not use the pool if you do not know how to swim. In some case, a diving board might be installed in the pool. Please use the diving pool carefully and according to the manufacturer’s instructions (i.e. maximum weight allowed etc.).

13.4. Please note that the swimming pool water is not drinkable (neither from people nor pets) and may contain salt and/or chlorine and/or any other suitable substance. Also please be aware that swimming pool water may have different buoyancies than the sea.

14. CHILDREN

14.1. Children are generally welcome in the Villas. However, some Villa Owners either have a “No Children Policy” or apply certain child age restrictions. In those cases, you will be notified by VIVESTIA beforehand and the term will be incorporated in the Booking Form. In the event you do not comply with this term, VIVESTIA and the Villa Owner reserves the right to ask you all guests to vacate the Property immediately

VIVESTIA will strive to inform you of the suitability of the Property for children. Please note that the supervision, safety and behavior of your children is your sole responsibility and VIVESTIA waives any liability that may arise.

15. PETS

15.1 Only some of our property owners accept pets. If you wish to bring one, you must ask VIVESTIA for written approval. An additional Security Deposit shall be requested. The amount may vary depending on the chosen property but will not be higher than your Security Deposit.

15.2. If pets are allowed you are responsible for your pet’s behavior. You are responsible under the Civil and Penal Greek law for any behavior of your pet (i.e. aggression, barking, damages of the Villa etc.) and any accident that might be caused by it (i.e. any and all damages in the property, injury, death etc.) and you will be held liable for any and all claims derive thereto.

16. BEHAVIOUR

16.1. If in the educated opinion of VIVESTIA, the Owner, or any other person in authority you, or a member of your party, behaves in a manner which causes or is likely to cause danger, excessive disturbance (i.e. to neighbors) or damage to the Property, or acts in breach of any provision in the Booking Documents, this Agreement may be terminated effective immediately and you shall all be requested to vacate the Property. In this event, you shall not receive any refund and you shall be held liable for any expenses and damages of any kind incurred as a result of your behavior or the behavior of persons in your party.

16.2. During your stay in the Villa you should fully comply with the Greek law. You hereby agree that during your stay you are not going to have in your possession and/or in the Villa any drugs and/or any other illegal substances for any purpose and/or guns of any kind and/or any other illegal objects and/or you are not going to be implicated in any and all forms of prostitution. If you possess any of the aforementioned or be implicated in any illegal acts the authorities will be notified, VIVESTIA and/or the Owner will terminate the lease without reimbursing you (including the security deposit), you will be asked to vacate the property immediately and you will be held liable for any claims arising hereto.

16.3. Villa Visitors are expected to use common sense and caution not to jeopardize the integrity of the buildings and structures or expose them to fire, explosives, flammable or pressurized liquids (e.g. scuba tanks, oxygen bottles, liquified gas bottles, etc). In case of such damage, guests will be held legally liable for such damages and charges shall be pressed through the Greek Judicial System.

16.4. Guests are expected to use common sense in not bothering neighbors or making noise on off-hours (14:30-18:00 and 23:00-08:00). The Homeowner will exert his right to terminate immediately a lease of a property without any reimbursement if official complaints are received for noise or drunken behavior during any time.

16.5. VIVESTIA and/or the Villa Owner will call the local police in any case of violation of the terms of this present or the Greek law, the lease will be immediately terminated without any reimbursement (including the security deposit), you will be asked to evacuate the Property and you will be held liable for any claims arising hereto. The above apply and in case the authorities are notified by any third parties.

16.6. In case of any emergency (i.e. fire, earthquake etc.) you should evacuate the Villa immediately, and you should follow the Owner’s evacuation plan, which you will find in the Villa, and you shall notify VIVESTIA immediately. We will do the best we can to find you another accommodation, however, we cannot guarantee availability, and we waive any and all liabilities arising hereto. VIVESTIA cannot be held liable towards you or any third party for any loss of personal items or damage of property deriving from any emergency (i.e. fire, earthquake etc).

17. DAMAGES / SECURITY DEPOSIT

17.1 The Property shall be checked by the Owner and/or VIVESTIA before and after the Rental Period. You shall be held liable for any proven damages or losses caused to the Property and its contents. We recommend that you ensure that your insurance policy covers accidental damage to the Property and its contents. Guests are expected to respect the Villas, their surrounding area (i.e. gardens, plants etc.) and their contents. Villa items, including and not limited to linen and/ornamental things/appliances etc. should remain with the villas.

17.2 You shall be liable for all costs related to the loss of any keys provided to you on the first day of the Rental Period.

17.3 Your Security Deposit shall be returned to you at the latest within 15 days from the end of the Rental Period. Potential proven damages or losses as per paragraph 16.1 will be deducted from your Security Deposit. In the exceptional case where the cost of repairing/replacing any proven damages exceeds the Security Deposit, you accept to cover the additional cost within 7 days of your notification.

18. LIMITATION OF LIABILITY

18.1. VIVESTIA is an agent of the Villa Owner and neither us nor any of its affiliated entities, shareholders, directors, employees, agents and representatives (“Affiliates”) is liable for any delays, accidents, damages, injuries or losses suffered by you, your guests or the Property. In no event, will VIVESTIA or its Affiliates be liable for any indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with this agreement or the rental or use of the Villa. If, despite the limitations contained herein, VIVESTIA or its Affiliates are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described herein, then the Company’s or its Affiliates’ liabilities will in no event exceed the total related rental revenue paid by you at the time of the occurrence. Following your booking, VIVESTIA may offer to help coordinate or organize certain guest services for you in connection with your property rental. Some of the service providers are independent contractors and are not representatives or employees of VIVESTIA. VIVESTIA and its Affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such service provider or for any personal injuries, property damage or other damages or expenses relating thereto.

VIVESTIA cannot be held liable towards you, the occupants or your guests for any accident, injury or death that occurred during your stay under any circumstance whatsoever.

18.2. VIVESTIA cannot be held liable towards you, the occupants or your guests for any loss or misplacement of valuables left in the Property during your stay. If provided, burglar alarms should be activated, safes used and suitable care is taken against theft and burglary. You should make sure to have all doors, panes, and windows closed and locked when leaving the accommodation. In the event of any theft or damage occurring through the negligence of yours, the Owner reserves the right to ask compensation from you.

If you travel with your vehicle or you rent a vehicle in the area and gets stolen either in the Property (i.e in the garage or parking area) or at any time during your vacation, VIVESTIA nor the Villa Owner cannot be held liable for you or any third party (i.e. car rental company).

You are responsible for your third-party liability, health, and medical repatriation insurances. VIVESTIA is not a travel agent, does not have such insurances, and shall not be held liable for the absence of such insurances

19. ADVERTISING & INTERNET INFORMATION

VIVESTIA truly believes that the information and statements in the content of its website are accurate. Every possible effort is made to fully and precisely describe each Property and service offered. Moreover, every possible effort is made to provide the services described on our website.

VIVESTIA reserves the right to change published information, prices, and itineraries mentioned on its website, without any prior notice. In case that such changes are communicated to you before the submission of the booking form, or after its submission but before the reservation is confirmed by VIVESTIA, those changes are binding for both parties.

VIVESTIA is not responsible for content, policies, and services which are connected/linked to or accessible through its website.

20. FORCE MAJEURE

VIVESTIA shall not bear any responsibility if the execution of this agreement is no longer possible because of force majeure. All of the following shall be considered force majeure: the threat of war, an act of terrorism, industrial action, dangerous weather conditions, fire, flood, drought, unexpected shutting down of an airport or harbor, unforeseen changes to transport time schedules, or any other event which is beyond the control of VIVESTIA.

21. COMPLAINTS AND PROBLEMS DURING YOUR STAY

21.1 While both VIVESTIA and the Villa Owner will do everything in their power to provide you with a trouble-free stay, a villa may present malfunctions like any other house. Our aim to mend any problem that arises within 24 hours may not always be feasible because of the time of day or day of the week, the location of the villa, the unavailability of technicians, etc. If you are dissatisfied with the Property or the service of a Supplier, please contact us immediately. It is a precondition for any compensation that you inform VIVESTIA in writing of all complaints as soon as possible and in any event not after the end of your Rental Period.

21.2 Please note that some of our properties are located on small islands with severe problems of drought. We kindly ask you to use water sparingly, especially during the summer months. Electricity and water shortages may, and do, occur in some areas and while we will do everything in our power to reestablish supply or remedy the situation, we cannot be held responsible for the inconvenience such shortages may create, by events beyond our control.

22. PERSONAL DATA

VIVESTIA shall act in compliance with legislation about personal data protection and specifically with the GDPR. All data are provided to us by you and enable us to process your final booking and the services you request. Security measures are in place to ensure that our guests’ database is not accessible to any unauthorized company or individual.

VIVESTIA does need to disclose some personal data to its Service Providers as well as to its Financial Administrator but shall not make the above-mentioned information available to these third parties without your explicit consent, provided in a special authorization form.

By sending an inquiry or proceeding with booking with “VIVESTIA”, you and all the guests participating in the trip automatically agree to all the above terms.

23. PARTIAL CANCELLATION

Partial cancellation of the provisions of the Booking Documents according to an agreement between the parties or to the decision of a judicial authority shall not affect the validity of the Booking Documents in its entirety.

24. APPLICABLE LAW-JURISDICTION

All disputes arising between you and/or your party on the one hand and VIVESTIA and/or any of its directors, officers, or employees on the other from or in connection with the Booking Documents and/or your stay at the Property, in general, shall be settled by the Courts of Athens, Greece by application of Greek Law.
